GenAI is not merely an abstract concept; it actively assists judges with their research, supports lawyers in preparing appeals, and aids individuals involved in cases to articulate their arguments effectively in court. "It’s probably used more than people expect," notes Daniel Linna, a Professor at the Northwestern Pritzker School of Law. He points out that while judges may not publicly discuss it, many individuals approach him to share their experiences experimenting with AI technology.

In a groundbreaking case, generative AI played a pivotal role when a digital avatar of murder victim Chris Pelkey appeared in an Arizona courtroom. This was a watershed moment in legal history, as the avatar echoed sentiments that humanized Pelkey, who was tragically killed in a road rage incident in 2021. Created by his sister Stacey Wales, the avatar conveyed a message of forgiveness that resonated with the judge and the courtroom. Wales knew this unique approach would be powerful in humanizing her brother in the eyes of the judicial system.

The Growing Acceptance of GenAI in Courts

Pelkey’s case marked the first time an AI-generated presence was used in court, and it has underscored the increasing integration of generative AI in legal proceedings. Stephen Schwartz, an attorney from Maine, emphasizes the utility of GenAI, stating it is a "helpful tool" that saves time, provided that its accuracy is verified.

However, this new technology is not without risks. There have been notorious incidents where AI-generated documents contained inaccuracies, leading to detrimental consequences. In early May, a federal judge penalized two law firms over a petition fraught with mistakes, labeling it a "collective debacle." The courts must therefore continue to tread carefully as they integrate this technology, ensuring that human oversight remains a priority.

Preparing for a Surge in Caseload

As GenAI simplifies the process of drafting legal complaints, courts that are already stretched thin may face an influx of cases. Shay Cleary of the National Center for State Courts emphasizes the need for judicial systems to adapt to this potential rise in numbers. However, Linna holds an optimistic view, believing that if applied correctly, GenAI could empower individuals who lack access to legal services. "These tools can be transformative," he asserts, "but we must be thoughtful about their integration."

In Washington D.C., federal judges have explicitly acknowledged using tools like ChatGPT to enhance their written decisions. This raises the stakes regarding how GenAI may influence legal outcomes. Linna argues that these AI assistants could significantly impact case rulings, similar to the role of human law clerks. If used effectively, GenAI could lead to better-supported judicial decisions that are less vulnerable to being overturned on appeal.
